Just like plumbers, electricians and HVAC contractors,effective July 1, 2008 residential and general contractors will also be required to have a Georgia state card that specifies the type of construction work they are allowed to perform. This does not replace your local license - when permitting you will be required to have both. The City of Kennesaw has adopted the building, fire and life safety codes, as mandated by the Georgia Department of Community Affairs (DCA), State Minimum Standard Codes (with GA amendments)and are updated on a regular basis as required by the DCA. A Copy of the Ordinance to adopt these codes can be obtained by written request to the City Clerks office.

The C.O. process has been set up to ensure the safety and building integrity between tenants/businesses. We check electrical outlets/fixtures & ADA requirements to ensure safety & the Cobb County Fire Marshal will ensure that all fire safety measures (emergency exit lights, extinguishers, etc.) are in place and working properly. |

Any changes in the name, owner or occupancy type of a structure will require a new C.O. to be issued with that information. This is to ensure that contact information is correct and zoning requirements are still being met. |

Always verify that the contractor has a State License for the type of work they are doing (Electric, Plumbing, Heat & Air) and a local business license. Also, make sure your contract is specific as to what you want done and the time period in which it will be complete. RESIDENTIAL if the business is operated out of your home; or you have a mobile business with your home address as your business address. A home occupation affidavit must be completed, notarized, and approved by the Zoning Administrator. This form is available at both the Business License Office and the Planning & Zoning Department. Notaries are available on staff. If you are a renter you will also need: (1) Privately owned home: a notarized letter from the homeowner, and a copy of your lease agreement. (2) Apartment complex: a letter from the property manager, on letterhead, along with the lease agreement, will be sufficient. (3) The letter must state that the homeowner/ property owner is allowing the home based business. Occupation taxes are determined by gross receipts, class of business according to the Standard Industrial Classification (SIC) code, plus a $55.00 administrative fee. The minimum fee is $80.00. Certain professional practitioners have the option of calculating their occupation tax in another manner. They may elect to pay a flat fee of $400 per registered professional. |

The City of Kennesaw has six (6) polling places used for both general and City elections. Please check your voter's registration card to see which is your polling place, or call the Cobb County Board of Elections and Registration at 770-528-2300. Terms for elected officials are four years, with elections being held every two years. The candidate receiving a plurality of votes shall be declared elected. To be eligible for office in the City of Kennesaw, a person must be 21 years of age and meet the requirements of a qualified vote in the City of Kennesaw as prescribed by State law and must have been a resident of the City of Kennesaw for 12 months. Elected officials take office the first day in January after the election. |

Finance

Check with the Zoning Department (at 770-590-8268) to make sure your business meets requirements for the location, and that no special permits are needed. If changes are being made, contact the Building Services Department (at 770-429-4554) for information regarding permits. A Certificate of Occupancy from the Building Services Department must be obtained for businesses located in a commercial zoning. Make an appointment with the Cobb County Fire Marshall's Office (at 770-528-8000) to take two copies of the floor plan drawing for approval. Bring a stamped copy of the floor plan to Building Services Department and pay the $25.00 permit fee. A permit number will be assigned. Make appointments for on-site inspections by the building inspectors and the fire department. After approval from fire department and building inspector, a Certificate of Occupancy may be obtained from Building Services. If business is located in a home, a statement must be signed regarding residency restrictions. After obtaining a Certificate of Occupancy application may be made for an Occupational Tax Certificate. If you are a corporation, a copy of your Certificate of Incorporation from the State is required. State licensed businesses must provide a copy of their State License. Any type of ownership other that sole proprietorship must provide a federal tax identification number. |

The major responsibility of Property Tax Billing is to ensure effective management of all taxes levied by the City which includes: real estate, personal property, Kennesaw Downtown Development Authority (KDDA), and public utilities. Assessed values are established by the Cobb County Tax Assessor’s Office and are currently calculated at 40 percent of the fair market value. The public utility assessments are supplied to the City by the State Revenue Department. Taxes on all the above categories are levied in the fall of each year on the assessed valuation of property of the preceding January 1 and are due sixty (60) days from the date of billing. Ad Valorem taxes on motor vehicles and mobile homes are collected by the Cobb County Tax Commissioner and remitted to the City. Burning Banned May 1 – September 30
The Georgia Department of Natural Resources has issued a ban on open burning May 1 – September 30 of each year. Fifty-four counties in Georgia (including Cobb County) are affected. Cobb County Fire and Emergency Services are responsible for the enforcement of this state-issued burning ban in unincorporated Cobb County, and the cities of Acworth, Kennesaw, and Powder SpringsFrom May 1 – September 30, you may not burn leaves, tree limbs, or other yard waste, forest land, or use air curtain destructors for commercial burning. The Current Restrictions Are:
In compliance with The State's amended Drought Response Level 4, beginning March 1, 2008, citizens will be able to hand water established landscapes for 25 minutes on the odd/even schedule from 4 a.m.- 9 a.m. Hand watering is defined as one person, with one hose with an automatic shutoff nozzle. • Even and Unnumbered addresses may water Mondays, Wednesdays, and Saturdays • Odd addresses may water Tuesdays, Thursdays, and Sundays In compliance with Cobb County’s Drought Response Plan adopted by the Cobb County Board of Commissioners on Tuesday, February 26, 2008, beginning April 1, 2008, citizens who complete the State of Georgia's online water conservation class at www.urbanagcouncil.com will be able to water newly installed landscape for 10 weeks on the odd/even schedule from 4 a.m. - 9 a.m. For more information on Cobb County's Drought Response Plan, and to download the landscape exemption form please visit the Cobb County Water Efficiency page of this website. The Cobb County Water System will strictly enforce these restrictions. Warnings are issued for a first offense. It's fast, easy, convenient and free (no online transaction fees). We only accept credit card payments over the Internet. 2) Via Fax: Complete the registration form in the back of the Kennesaw Parks & Recreation Program Guide and fax it to (678) 460-3373. Property Tax

Property taxes are billed in the fall of the year, usually on October 1st, for City Taxes that cover January 1- December 31 of that year. The due date is 60 days from the date taxes are billed (O.C.G.A. 48-5-148). You should receive a separate statement from Cobb County for your County/State/School Taxes.
Interest at a rate of 1% of the original tax amount is added on 1st day taxes become past due and every 30 days thereafter until the balance is paid in full (O.C.G.A. 48-2-40). When taxes become 30 days past due, a Fi.Fa. (tax lien) is placed on the account and a recording fee is charged(O.C.G.A. 48-3-3). If taxes become 90 days past due a penalty of 10% or $10.00, whichever is greater, is added to the balance (O.C.G.A. 48-2-44). |

Taxes for the current year can be paid by mailing a check to the City of Kennesaw, 2529 J.O. Stephenson Ave, Kennesaw, GA 30144. Please make your check payable to the City of Kennesaw. Payments may also be made in person at Kennesaw City Hall (above address) during normal business hours of 8:00 a.m. – 5:00 p.m. Monday-Friday excluding holidays. We accept cash, check or money order payments. If your taxes are paid in escrow, please forward your tax statement to your mortgage company and they will pay us. We mail statements to taxpayers and will be glad to send statements to mortgage companies. It is the homowner's responsibility to ensure we have the correct mortgage company name and mailing address. We do get requests from mortgage companies for tax amounts on specific parcels and provide them with taxes due at that time. Taxes for 2005 and all prior years can be found on the Cobb county Tax Assessor’s website (www.cobbassessor.org). This database can be searched using an address or account number. Copies of tax bills for 2005 and prior years can be printed from the Cobb County Tax Commissioner’s office website (www.cobbtax.org). The 2006 and 2007 taxes are available on our website at www.kennesaw-ga.gov (Click "View My Property Tax Info"). 2008 taxes will be available in the fall of this year. |

Taxes are billed at the end of each year for the period of January 1 – December 31. These bills are generated as of January 1. What generally happens at a closing is a transaction between the buyer and seller for the seller’s portion of estimated taxes that will become due at the end of the year. In this instance, taxes are collected from the seller and paid to the buyer by reducing the proceeds paid to the seller at closing. Taxes are not paid to the City of Kennesaw. If taxes are to be “collected” at a closing, it is stated in the sales contract and the lawyer’s office will forward taxes collected to the City of Kennesaw. The State of Georgia requires that tax bills are generated and mailed to the owner of record on January 1st so the seller will receive a bill on property that they have sold (O.C.G.A. 48-5-18). Both buyer and seller are made aware of this at closing and the property tax bill also states that this bill should be forwarded to the new owner. This can be very confusing and often results in taxes becoming past due. Failure to receive a tax bill does not relieve this liability. Please contact your closing attorney or the City of Kennesaw if you have questions. |

Tax bills are mailed to the taxpayer. Mortgages change so frequently that we find it more convenient to the taxpayer to send the bills directly to them. We do send statements to mortgage companies if the company name and mailing address are provided to us. We ask that you forward your tax statement to your mortgage company for payment if your statement does not indicate that we have already mailed a statement to your mortgage company. We commonly get requests from mortgage companies for tax amounts due and promptly make those amounts available to them at that time. |

Taxes are generated and mailed to the owner of record on January 1st of the tax year according to Georgia law (O.C.G.A. 48-5-18). If you get a tax bill for property that you sold please forward it to the new owner as quickly as possible. You may also return the bill to us with the new owner’s name and address and we will gladly update our records and forward the bill to the new owner. |

There are homestead exemptions available to homeowners that complete and file the required applications by April 1st of the tax year (O.C.G.A 48-5-40 through 48-5-54). To be eligible for application you must own, occupy, and claim your property as your legal residence on January 1st. Only one person need apply if more than one name appears on the deed. The exemptions are automatically renewed each year unless there is a change in ownership or you no longer meet the eligibility requirements. State Exemptions:

Floating Homestead – Balance of increase in assessed value of home at time homestead exemption granted. There must be an application on file for regular homestead with Cobb County. Over 65 Exemption – Residents who have homestead exemption with Cobb County and are 65 years of age on January 1 (must provide proof of age with driver’s license or Georgia I.D.). The millage rate for City taxes is currently 8.0 mils. A bond tax approved by voters in 2004 for recreation and transportation improvements was added in Fiscal Year 2005, for 1.5 mils. |

Our property tax digest is completed by the Cobb County Tax Assessor’s Office and the Cobb County Tax Commissioner’s Office. Our tax bills are generated from this information when we receive the digest, usually in late July each year as follows: Fair Market Value of Property (as determined by the Cobb County Assessor’s Office) $100,000. multiplied by 40% (which is what GA Dept of Rev says we are able to tax) equals $40,000 of Assessed Value. Exemptions are then removed from the assessed value such as the homestead exemption. If you have applied and are eligible to receive this exemption then your taxable amount is $32,000. The City Tax of 9.50 mils would then be applied to the taxable amount for every $1,000. $32,000/1000 = $32 X 8.00 = $256.00
OR
$32,000 X .00800 = $256.00 The Bond Tax of 1.5 would be applied in the same manner, however there are some exemptions that do not apply to the Bond Tax such as the homestead exemption. $40,000/1000 = $40. X 1.5 = $60.00
OR
$40,000 X .0015 = $60.00 The total for the tax bill would be $316.00. |
